And how are false reports handled?

Do whistleblowers have to fear reprisals?

The most important point: Anyone who submits a whistleblower false report will not be punished initially.
According to the Whistleblower Protection Act, no increased verification requirements may be imposed on the whistleblower.

This means: whistleblowing persons are granted protection even if the report is incorrect, provided that at the time of the report the person assumed the information to be true.

Deliberate false reports are punishable by law.
And false reports can also have far-reaching consequences for the affected person.

The situation is different if a whistleblower knowingly submits a false report.

There is no protection if, for example, intentionally or through gross negligence, incorrect information is reported.

This may result in the whistleblowing person being obligated to compensate for damages.
This is governed by Section 38 of the HinSchG.
